Public Hearing on Guidelines on Ancillary Services Undertakings

The European Banking Authority will hold a virtual public hearing on September 2 to discuss its draft Guidelines on Ancillary Services Undertakings (ASUs). Consultation Background

The EBA launched this public consultation on July 9, proposing clear, consistent criteria for identifying ASU activities under the CRR. The draft Guidelines aim to promote convergence in institutional and supervisory practices regarding ASU identification, ensuring a level playing field and enhancing comparability of prudential requirements across the EU.

Proper ASU identification is essential for consistent application of the prudential framework and determines prudential consolidation scope for banking groups. The Guidelines establish criteria for identifying activities considered "direct extension of banking" and those "ancillary to banking," while outlining processes to identify emerging activities that may pose similar risks. These Guidelines fulfill the mandate under Article 4(5) of the CRR as part of the EBA's EU banking package implementation.

Hearing Details

This virtual session provides stakeholders an opportunity to discuss the proposed Guidelines and their practical implications for banking group consolidation and prudential requirements. The consultation period remains open until October 7, allowing participants to submit detailed comments following the hearing.
