ECB Supervisory Chair Urges Broader Evaluation of Bank Regulation and Stronger Accountability

ECB Supervisory Board Chair Claudia Buch called for comprehensive, evidence-based evaluation of prudential regulation and supervision, a broader stakeholder debate, and better data infrastructure. She also previewed the revised 2026 Pillar 2 methodology and argued against permanent capital reductions as a way to stimulate lending. Compliance teams should treat the speech as a signal of supervisory priorities, not as new binding requirements, as the EU banking competitiveness legislative process unfolds.

ASIC Form 509D Sets Liquidator Notice Requirements for Special Resolutions to Wind Up Companies

ASIC's Form 509D requires liquidators to notify ASIC when a company is taken to have passed a special resolution to wind up voluntarily following external administration or the termination of a deed of company arrangement (DOCA). The notice must be lodged within 5 business days, and late fees apply. Compliance and legal teams handling distressed counterparties, or the insolvency of group entities, should confirm that lodgement processes are in place.

Finanstilsynet Republishes French AMF Warning on Crypto Website neuve-markvere.com

Norway's Financial Supervisory Authority (Finanstilsynet) has posted a warning about neuve-markvere.com, a website that France's Autorité des Marchés Financiers (AMF) added to its crypto-currency blacklist. Compliance teams should treat the domain as a suspected unauthorized or fraudulent crypto operation and update screening and monitoring controls accordingly.

Finansinspektionen Amends Mutual Fund Rules on Fund Company Investment Advice Under FFFS 2026:28

Finansinspektionen has amended Chapter 22, Section 3 of FFFS 2013:9, which sets conduct requirements for fund companies that advise clients on fund units outside the scope of Chapter 7, Section 1, first paragraph, 4 of the Swedish Act on Mutual Funds (2004:46). The amended rules take effect October 1, 2026, which leaves only about two weeks after the decision date of September 15, 2026. Fund companies offering such advice should promptly confirm that their advisory processes align with the referenced MiFID 2 Delegated Regulation articles and the securities business rules.

AMF Publishes SPOT Inspection Findings on Telephone Recording at Asset Management Companies

The AMF has released the results of its thematic SPOT inspections of five asset management companies on telephone conversation recording, and identified good and poor practices. Telephone ordering is declining, but the AMF warns that its marginal use can increase non-compliance risk because controls are often weaker. Compliance teams should benchmark their recording policies, controls, and training against these findings.

ASIC Form 509G Sets Notice Requirements for Terminating a Deed of Company Arrangement

ASIC has published Form 509G, the notice an administrator must use when creditors vote to terminate a deed of company arrangement (DOCA) under s450D of the Corporations Act 2001. The form is an administrative template rather than a new rule, but it documents how a DOCA termination is recorded on the public register and how creditors are notified. Compliance teams with exposure to Australian counterparties in external administration should understand the process and its implications.

ASIC Extends Market Relief for Exchange-Traded Derivatives and Securities for Five Years

ASIC has remade three legislative instruments and extended a fourth for five years, preserving existing relief for exchange-traded derivatives disclosure, trans-Tasman securities settlement, foreign securities transfers, and securities lending. The relief itself is unchanged, but the instruments have new numbers and some wording and reference updates. Compliance teams should confirm that policies and legal references cite the correct instruments.
